As increasing numbers of I-140 downgrade cases are being processed, backlogs of old I-485 applications are being cleared out, and Consulates are gradually resuming normal operations, Immigration practitioners are facing queries from USCIS and Department of State about previously unidentified issues that can have long-reaching impact. Our panel of experts will provide recommendations on how to handle those surprises as well as how to inoculate cases against such unwelcome news in the future. This advanced-level presentation will focus on creative strategies when the government seeks evidence that has long since become stale, as well as arguments to combat allegations of fraud for perceived inconsistencies.

Featured Topics:

  • Responding to Requests for Evidence (RFE) on EB-3 Downgrades: Changes in Underlying Employment and Unavailable Evidence
  • I-140 Notice of Intent to Revoke When the Beneficiary Has Already Invoked AC21
  • Inconsistencies vs. Fraud in Related and Unrelated Cases, Including:
    • DS-160 Information Being Raised in an I-140 RFE
    • Resumé Inconsistencies
    • Social Media Information
    • Working Without Authorization for Previous Employers
