Since March 2020, the I-9 requirements have been modified several times by U.S. Immigration and Customs Enforcement (ICE), but these COVID flexibilities will officially end on July 31, with a grace period through August 30. The expert faculty on this intermediate seminar will review requirements for remote verification, Form I-9 compliance upon resumption of normal business operations, and the use of authorized representatives to verify employment eligibility and identification. They will also delve into measures for remediation and correction of any Form I-9 lapses or noncompliance. Finally, the panelists will discuss the new alternative (i.e., virtual) procedure for document review and how it impacts employers’ compliance efforts with respect to the end of the COVID flexibilities.

Featured Topics:

  • Sunset of Form I-9 COVID flexibilities: are you ready for August 31?
  • What to do when an employer’s workforce returns to the office or uses a hybrid model
  • Pitfalls of the two-step verification process
  • Internal audits and use of electronic Forms I-9 to ease compliance
  • Interplay with state-mandated E-verify requirements
  • New virtual document review option: who can use the alternative procedure to complete verification for Forms I-9 created pursuant to the COVID flexibilities?
