Waiver practice occurs in both family– and employment-based immigration cases. It can be tricky to know exactly which form to use, as well as when and where to file. Our expert panelists will help demystify this often-complicated process.

Featured Topics:

  • Does your client need a waiver? Determining whether the inadmissibility period has expired
  • Is departure necessary? When is consular processing an option (instead of a requirement)?
  • Timing: When can you file in advance? When do you wait for a consular refusal?
  • Logistics: Can you file an I-212 and I-601 simultaneously? Is there a specific sequence that must be followed? Which filing locations are appropriate, and in what situations?
  • What can you do about delays? Expediting waivers and the status of current litigation
