Understanding INA §§235 and 236 and the Implications for Detention and Parole Issues

Following the Supreme Court's ruling in Jennings v. Rodriguez, 138 S.Ct. 830 (2018), which implemented a strict construction of mandatory detention for applicants for admission, litigation has spurred relating to habeas, state challenges to Biden Administration policies, and whether released applicants for admission can pursue adjustment of status. For this quarterly call, we will review the statutory interpretation behind the holding in Jennings, how it has been used to pursue relief for clients, and ongoing litigation relating to the meaning of these statutes and the possible implications of those cases.
