Admissibility Issues in Employment-Based Cases

Immigration attorneys who have predominantly employment-based cases may feel insulated from dealing with matters of inadmissibility or visa ineligibility; however, they should not be lulled into a false sense of security. Even employment-based beneficiaries come with a past and identifying/dealing with issues that may prevent or delay visa issuance once a petition is approved may not only determine the success of the case but influence your ongoing relationship with the corporate client. The panelists giving this intermediate presentation will provide an overview of the most common issues of inadmissibility that arise in employment-based cases and how to deal with them.

- Alcohol– and Drug-Related Issues and Health Grounds
- Past U.S. Immigration Violations
- Vetting the Beneficiary’s Public “Persona” on Social Media, LinkedIn, etc.
- Misrepresentation Based on Previous Visa Applications or Submissions to U.S. Citizenship and Immigration Services (USCIS)
- Dealing With Extensions When a Consular Waiver Was Issued

Daniel Parisi is Of Counsel at Tocci, Lee, Brill & Parisi in London. Daniel has practiced Immigration Law since 2003 and has a particular focus on consular issues and waivers of inadmissibility. Daniel served for seven years on AILA’s Department of State Liaison Committee (2 years as Chair) and is the current Chair of AILA’s RDC-EMEA Chapter. He has a BA in Foreign Languages (Spanish and French) and a JD from New York Law School.
Mary E. Kramer, Author, Immigration Consequences of Criminal Activity: A Guide to Representing Foreign-Born Defendants, 8th ed./AILA DOS Liaison Committee, Miami, FL
Mary Elizabeth Kramer has been practicing Immigration Law in Miami for over twenty years. She is a member of the Florida Bar, the Wisconsin Bar, and the American Immigration Lawyers Association. She is also admitted to practice before the Federal Court of Appeals for the Eleventh Judicial Circuit, the United States District Court for the Southern District of Florida, and the United States Supreme Court. Ms. Kramer graduated cum laude from the College of Saint Benedict in St. Joseph, Minnesota, and earned her law degree from the University of Wisconsin-Madison. Ms. Kramer is a past president of the American Immigration Lawyers Association South Florida Chapter and is the past President of the Board of Catholic Legal Services.
Cheryl David, AILA USCIS HQ (Benefits Policy) Liaison Committee, New York, NY
Cheryl R. David has been practicing immigration law since 1995. She handles all aspects of immigration law with an emphasis on removal and family-based cases. She is a frequent lecturer on issues related to removal and complicated family-based cases. She is the Co-Chair for (American Immigration Lawyers Association “AILA” of the NY Executive Office for Immigration Review) and she serves on the U.S. Citizenship & Immigration Service Headquarters Committee for AILA. She is currently on the Board of Directors of ASISTA. She was the Chair in 2020-21 of the Removal Defense Steering Committee and served on the Department of State National Committee of AILA from 2018-2020.
