Consular practice strikes fear in the heart of even advanced practitioners due to the lack of attorney representation at interviews and the non-reviewability of consular decisions. What happens when you’ve prepared your client but you’re still hit with a surprise at the consulate? Did your client decide it was time to confess all his sins? Did the consulate find a document that questions everything you knew to be true about your client’s case? The faculty on this intermediate to advanced panel will discuss how to prepare for and handle the common problems practitioners need to overcome after a client has a bad interview at the consular post.

Featured Topics:

  • Planning Ahead for What Could Go Wrong by Fully Preparing Your Client
  • Handling Prior Sins: Smuggling, Criminal Convictions, Suspected Gang Affiliations, Prior Alcohol or Drug Use, and Fraud and/or Inconsistencies
  • Prior In Absentia Orders and the 212(a)(6)(8) Bar After Approved I-212/I-601A
  • Medical and Alcohol/Drug Holds for Administrative Processing
  • When Should You Give in and File a Waiver “Under Protest”?
