Understanding 245(i) Adjustment

Although INA 245(i) expired on April 30, 2001, many people remain eligible for this unique benefit. Legacy INS and USCIS have issued multiple memoranda on 245(i) eligibility and the courts of appeals have also weighed in. This panel will provide an overview of the eligibility requirements for 245(i), review agency interpretations of the statute, and provide an update on BIA and federal court litigation.

James D. Eiss is a former INS officer who has been practicing law in the Buffalo, New York area for the past 16 years.


James C. Wolf, Walnut Creek, CA
James C. Wolf is an attorney at Lipman & Wolf and is a certified expert in immigration and nationality law by the State Bar of California. He has been providing immigration services to major corporations since the late 1980's. He is a graduate of Georgetown University School of Foreign Service and the University of California School of Law at Davis. He is an AILA attorney mentor. In this capacity, he advises other immigration lawyers across the United States about complex business immigration issues. In addition, he has served as an immigration law trainer and presenter at various seminars and speaking engagements.


Olsi Vrapi, Albuquerque, NM
Olsi Vrapi is a partner at Noble & Vrapi, P.A. with offices in Albuquerque and Santa Fe, NM. He is the Chair of the Annual Conference Due Process Track Committee, a member of the National EOIR Liaison Committee and an editor of the Consular Processing Guide. Mr. Vrapi also serves as the ICE liaison for New Mexico. He is also an Adjunct Professor of Law at the University of New Mexico School of Law.
