AILA Ethics Compendium- Modern Legal Ethics for Immigration Lawyers
This noteworthy project, headed by the AILA Ethics Committee and the AILA Practice & Professionalism Center, separately analyzes state and federal professional conduct rules, court opinions, legal ethics opinions, and other authority to provide information and guidance to immigration lawyers. Each chapter identifies the relevant ABA Model Rule, discusses the key terms used in the Rule, provides commentary for each sub-section, analyzes state rule variations of states that vary substantially from the ABA Rule, and offers immigration related hypotheticals involving the application of the Rule and recommendations on the best way to handle the issues presented.
The 2016 updated AILA Ethics Compendium covers nine ABA Model rules, including 1.1 Competence, 1.3 Diligence, 1.6 Confidentiality of Information, 1.14 Client with Diminished Capacity, 1.16 Declining or Terminating Representation, 3.3 Candor toward the Tribunal, 4.1 Truthfulness in Statements to Others, 5.3 Responsibilities Regarding Nonlawyer Assistance and 5.5 Unauthorized Practice of Law; Multijurisdictional Practice of Law.
Other rules currently in progress include ABA Model Rule 1.5 Fees, 1.15 Safekeeping Property and 1.7 Conflict of interest-Current Clients.
