With increasing demand for professional workers in the technology sector, there is a corresponding increase in opportunities for individuals already holding H-1B status to “transfer” to another job. The process allowing an H-1B employee to “port” to a new employer before USCIS approves the H-1B petition submitted by that new employer, however, is not always straightforward. The panelists will discuss issues that arise with H-1B portability as well as strategies to recommend to employers and foreign nationals to make a successful transfer.

FacultyStaci M. Jenkins (DL), Cincinnati, OH
Staci M. Jenkins is a partner with Thompson Hine, LLP, focusing her practice on employment-based immigration. While she counts several global and Fortune 500 companies among her clients, she also concentrates on advising healthcare entities. She is a past board member of the Cincinnati Bar Association's Immigration Committee and is the president-elect of the Healthcare Businesswomen's Association's Ohio Chapter. Ms. Jenkins received her J.D. from the University of Cincinnati College Of Law in 2005.
Monica Sherman, San Diego, CA
Monica Sherman is an associate in the San Diego office of Fragomen, Del Rey, Bernsen & Loewy, LLP, where she assists individual and corporate clients with the filing of PERM applications, employment-based nonimmigrant and immigrant visa petitions, adjustment of status applications, outstanding researcher petitions, and extraordinary ability petitions. Prior to joining Fragomen, she was an associate at a San Diego immigration law practice where she handled a wide range of immigration matters. Ms. Sherman is a volunteer attorney for Casa Cornelia Law Center, where she prepares VAWA petitions for immigrant victims of domestic violence and U visa petitions for immigrant victims of crimes.
Mark Yelich, Washington, DC
Mark Yelich focuses his practice on employment-based immigration. He represents clients in nonimmigrant and immigrant visa matters before the U.S. Department of Labor, U.S. Department of State, and U.S. Citizenship and Immigration Services. Mr. Yelich graduated from The Catholic University of America's Columbus School of Law in May 2009, and received a B.A. in philosophy from John Carroll University. Prior to graduating from law school, he was a law clerk at Maggio + Kattar for two years. He is a member of the Maryland State Bar Association.
